1. Applicability
These general and production conditions apply to all offers, agreements, deliveries, and works carried out by Glansbeton. They form an integral part of the contractual relationship between the parties and take precedence over any conditions of the customer, unless otherwise agreed in writing.
2. Quotations and contract
All prices stated in our offers are non-binding and exclusive of VAT, unless expressly stated otherwise. Additional work, extra materials, changes or additions will be charged separately at the unit prices stated in the offer or, in the absence thereof, at the usual market rates.
The quotation becomes binding as soon as the client orders in writing, signs the quotation or as soon as the execution of the works begins. Only the explicitly stated services and materials are part of the agreement.
3. Execution and deadlines
The stated execution periods are indicative and always approximate. Exceeding a period does not entitle the customer to terminate the agreement, claim damages or refuse payment, unless a strict deadline has been expressly agreed in writing.
In case of force majeure, unforeseen circumstances or circumstances beyond the control of Glansbeton, Glansbeton has the right to suspend execution or terminate the agreement without any compensation being owed.
A project whose execution has been requested may be postponed free of charge if written notice is given at least 20 working days before the scheduled execution. In the event of later postponement, Glansbeton reserves the right to charge 25% of the planned turnover amount for the project concerned as compensation for costs incurred, reservation, planning and loss of profit.
4. Payment terms
The assignment of the works is considered final upon receipt of the offer or order form signed in agreement and, if applicable, upon receipt of the agreed advance payment.
Unless otherwise agreed in writing, the following payment terms apply:
- 30% upon order confirmation;
- 30% at the start of the works;
- the balance within 30 days after the works have been carried out.
All invoices are payable at the registered office of Glansbeton. Taxes, duties and VAT are payable by the customer.
In case of non-payment on the due date, interest on arrears is owed by operation of law and without prior notice of default, in accordance with the applicable statutory interest rate for commercial transactions.
In addition, in case of late payment, a fixed compensation of 10% of the outstanding amount is due, with a minimum of 250 euros, without prejudice to the right of Glansbeton to prove and claim higher actual damages.
5. Delivery and complaints
If the project owner or main contractor does not provide a signed handover report or a reasoned reservation in writing within 48 hours after execution, the works are deemed provisionally accepted. In that case, Glansbeton may issue the invoice and submit it for payment.
After this period has expired, the customer can no longer invoke the absence of a delivery document as a reason to postpone payment.
Complaints concerning the invoice or visible defects must be submitted in writing, with reasons, within 8 calendar days after the invoice date or execution of the works, failing which the right to raise those complaints lapses.
Submitting a complaint does not suspend the payment obligation for the undisputed portion of the invoice.
6. Liability
The client is fully responsible for any damage to driveways, utility lines, underground structures, existing buildings or other infrastructure on or around the site.
The client must provide all necessary information and instructions in writing and in a timely manner regarding, among other things, floor levels, connections, separation lines, accesses and other relevant execution data. Glansbeton is not liable for the consequences of incomplete, late or incorrect information.
In case of dispute or disagreement, the client may not offset payments with other sites, invoices or agreements, even when the execution takes place outside Belgium.
Glansbeton expressly rejects all other purchase, sale, or production conditions of the customer, unless previously accepted in writing.
7. Production conditions
The works are carried out in accordance with the applicable technical regulations and accepted standards of workmanship. Glansbeton informs its customers and contractors that failure to comply with the conditions below may lead to loss of quality, execution problems or damage to the floor slab. In such cases, Glansbeton cannot be held liable for the resulting consequences. Requesting the start of the works implies acceptance of these production conditions.
7.1 General technical conditions
- At the start of the concrete pour, a responsible person or authorised representative of the project owner or client must be present on site.
- The site tests must demonstrate a minimum ground resistance of K = 6 kg/cm².
- Levelling and fine levelling must be correctly carried out before the start of the works.
- The temperature during the processing of the floor must be between +2 °C and +22 °C.
- The floor slab must not be exposed to rain, wind, or other weather influences. The building must be wind- and watertight.
- An outdoor floor slab always involves an increased technical risk. This risk remains entirely with the customer and cannot be claimed from Glansbeton.
- Cracking is inherent to the behaviour of concrete and cannot be completely excluded. Any repairs with filler material are not part of the original agreement and require a separate assignment.
- The reinforcement must be placed and checked in accordance with the applicable standards and according to the rules of the trade before the concrete pour.
- The client or contractor must provide sufficient spacers for each type of reinforcement mesh. If our employees have to lift or correct the meshes during execution, the responsibility for this remains entirely with the contractor.
- The type of cement used must be adapted to the processing temperature and comply with the specified technical requirements.
- The granulometry and consistency of the concrete must be suitable for the intended floor construction and method of execution.
- The concrete must comply with the previously specified technical specifications.
7.2 Site organisation and provisions
- Each room must have a clearly marked zero level.
- Edge work in separate rooms may result in an additional charge due to extra manual labour.
- For anti-slip or brushed floors, the desired degree of roughness must be specified by the customer or contractor during execution.
- In the absence of instructions, the interpretation of Glansbeton shall be deemed accepted.
- A completely uniform roughness over the entire surface is not guaranteed.
- The client must provide running water with a standard connection and electricity of 220V – 16A, per 200 m² and per room, at a maximum of 10 metres from the entrance of the relevant room.
- For pumping, a suitable pump must be provided, including sufficient piping and at least 20 metres of flexible hose without a steel nozzle.
- When the works take place in a basement or on an upper floor, the customer must provide the necessary infrastructure, such as a forklift, hoist or lift, so that materials and machines can be safely brought to the workplace.
- When working in an enclosed space, the customer must ensure sufficient exhaust of gases and supply of fresh air.
- If the gas detection of Glansbeton detects an unsafe situation, the works will be stopped immediately. In that case, the financial consequences remain the responsibility of the client.
7.3 Permits, accessibility and execution
- All permits, authorisations and administrative formalities required for the execution of the works, including any permits for night work, are solely the responsibility of the customer.
- If the works are halted by government services due to night noise, missing permits or other external reasons, any resulting damage cannot be claimed from Glansbeton.
- Permits and parking authorisations are the responsibility of the customer.
- Any parking fines will be charged.
- The setup of the pump and all necessary protective measures against spilling or contamination are the responsibility of the customer or contractor.
- The supplied amount of concrete must be adjustable upon request of Glansbeton.
- If Glansbeton works with materials included, additional concrete will be charged separately at the applicable price per m³, excluding fibres, admixtures, pumping and any lost load of concrete.
- Filling expansion joints with elastic sealant is not part of the standard service package of Glansbeton and is not included, unless explicitly stated otherwise in the quotation.
- The floor slab must be accessible for trucks both at the start and at the end point of the concreting.
- There must be a free gate opening at those locations of at least 150 cm wide and 200 cm high.
- When using industrial machines, pits, pipes, heating systems, window profiles and other obstacles must be removed or sufficiently protected in advance.
- This protection is the responsibility of the customer or contractor. In case of insufficient protection, Glansbeton is not liable for any damage.
- The client or contractor must provide a mobile phone number of a permanently reachable contact person before the start of the works for the entire duration of production, so that immediate consultation is possible in case of power failure, obstruction or other incidents.
8. Applicable law and competent court
All agreements are exclusively subject to Belgian law. In case of dispute, only the competent courts of the judicial district of Limburg, Hasselt division, have jurisdiction, unless mandatory legal provisions dictate otherwise.
